The European Commission referred Belgium to the Court in October 2014 because decisions of the regulator could be suspended, and its multi-annual strategy had to be approved by the Government, hence unermining its independence.
In February 2015, the Belgian Government has submitted amending legislation to the Parliament to ensure the independence of the NRA. The law is being discussed and is expected to be adopted shortly. As the law would remove the contentious provisions of Belgian law, the decision has been taken to suspend the referral.
